This Puppy is sold with Limited AKC Registration (Until which time both owners are in agreement)

GUARANTEES;

1. This Puppy is purebred, pedigree is correct, and litter is registered with the AKC.
2. The parents of this puppy have been established that they are free of hip dysplasia.
3. The Puppy is healthy on delivery, has been de-wormed, vaccinated, examined by a veterinarian, and comes with a veterinarian health certificate.  Illness must be confirmed by Purchaser’s veterinarian, at Purchaser’s expense, within 72 hours of the date of this Contract; the Breeder does not assume any liability for any injury to said Puppy after purchase.
4. The Puppy is guaranteed against permanent crippling or debilitating genetic defects for two (2) years from the date of this Contract. (In the case of hips, that would be an OFA grade of less than Fair.
5. This Puppy is sold solely as a pet and companion to the immediate family.  There are many factors that can influence growth and development, such as socialization, diet, exercise, weight gain, etc.  The Purchaser assumes the responsibility to carry on with the vaccination, exercise and feeding schedule and instructions as supplied by the Breeder, (a copy of which is attached hereto as Schedule “A”), failing which all warranties are null and void.
6. If the Purchaser can verifiably demonstrate the Dog’s failure to fulfill these guarantees, and the Dog is euthanized on a veterinarian’s recommendation, or the Dog is returned to the Breeder with a signed AKC transfer, the Breeder will replace the Dog with a puppy of similar value or give a full or partial refund, Breeder’s option.  If the Purchaser chooses to keep the Dog and provides proof that said Dog has been spayed or neutered, then the Breeder will refund the purchase price, or provide another puppy of similar value, Breeder’s option.  The Purchaser’s remedy for the breach of any aforementioned guarantee is limited to the purchase price of the Dog on this Contract.
   • These guarantees apply to the original Purchaser only and are NOT transferable.  The Breeder reserves the right to a second veterinarian’s opinion of Breeder’s choosing.  A full veterinary examination and report, to be paid for by the Purchaser, which includes x-rays, test results, and blood work must be supplied to the Breeder and Breeder’s choice of veterinarian, upon request.  When the cause of death is unknown, an autopsy must be performed at the Purchaser’s cost.

CONDITIONS

1. The Purchaser agrees to take the Puppy to the Purchaser’s own licensed veterinarian within 72 hours of purchase for a health check at Purchaser’s expense.  If the veterinarian determines the Puppy to be ill, Purchaser may return the Puppy within one (1) day of examination for a full refund.
2. The Purchaser agrees to take good and proper care of the Puppy and agrees that said Puppy will reside at the home of the Purchaser; the Purchaser further agrees to inform the Breeder when the Purchaser moves or changes phone numbers for the life of the Dog; furthermore, the Purchaser agrees that he or she is not acting as an agent in the purchase of the above-identified Puppy.
3. The Purchaser agrees that the Puppy is not to be left in a backyard or kennel only; the Puppy is sold with the understanding that the Puppy will become part of the Purchaser’s family.
4. The Purchaser agrees NEVER to leave a choke chain type collar on the Puppy when crated or unsupervised, the Purchaser also agrees never to use a shock collar on said Dog; the Purchaser further agrees that the Dog is not to be used or trained as a guard dog, attack dog, but as a personal protection dog only.
5. The Purchaser agrees that the Puppy will be given adequate shade, shelter and housing, have access to a fenced yard, and will be properly and sufficiently fed, while not being allowed to become obese.  Said Puppy will receive proper veterinary care throughout its lifetime, including annual (or as recommended) vaccinations and  preventative health care.  The Purchaser further agrees that the Puppy shall not be mistreated or abused, be allowed to run loose, nor shall it be kept chained or tied or allowed to ride in the back of an open pick-up truck.**
6. The Purchaser will spay/neuter the Dog before the Dog reaches the age of 9 months (or as recommended by Purchaser’s veterinarian) and will provide certification of this to Breeder; the Purchaser further agrees to prevent said Dog from breeding, even by accident.  Any breeding of said Dog shall result in the Contract becoming null and void.
7. Purchaser guarantees Breeder the right of first refusal if the Dog is to be sold or disposed of in any way.  Signed AKC registration papers must accompany the Dog, and a suitable refund may be made upon placement of the Dog, at the Breeder’s discretion.   Purchaser agrees not to sell, trade, lease out, euthanize (except under emergency conditions to end suffering), or give away the Dog without the written permission of the Breeder.  (We would not sell a Puppy to some people who are not responsible dog owners and we also would not want them to buy one of our dogs from a third party.)

** Under the terms of this Contract, Breeder has the right to investigate the care of the Puppy if circumstances warrant.  If w feel the Puppy is not getting proper care and treatment, the Purchaser shall have 72 hours to return the Dog and the signed AKC registration transfer to the Breeder at his own expense.  If Purchaser fails to do so, the Breeder shall have the legal right to repossess the Dog and get a signed AKC transfer application for the Purchaser without refunding any money.  In addition, the Purchaser shall be liable for any expenses incurred in the process of repossession (including legal fees and court costs), and vet expenses to restore the Dog to good health if necessary.   If it is not possible for the Purchaser to return the Dog and AKC registration, the Breeder will recover the greater sum of $1000. or the purchase price of the Dog, as damages for breach of Contract.  The parties to this contract agree to submit to the jurisdiction of the Laws of the State of Ohio and The United States Legal System for any dispute arising out of this Contract.

The Breeder neither makes nor implies any warranties or guarantees, express or implied, other than those written in the Agreement.  This document constitutes the entire Agreement between the Breeder and Purchaser with respect to this sale.  The Purchaser’s signature below indicates that he or she has read, agrees and does understand all the conditions of the Sales Agreement and Guarantee
